3 Different Education Savings Plans Compared - Trusts - New York ...

During tax season, you hear about all sorts of tools to help you save on taxes and help you plan your investments more prudently. If you have children, you might want to consider saving for their education.

There are several options for education savings. The three that most people consider are the custodial account, the Coverdell ESA, and the 529 Plan.

Let's look at all three.

Custodial Accounts

These accounts are like basic trusts for minors. An adult opens an account for the benefit of a minor. The custodial accounts are an irrevocable gift to the minor. You can contribute up to the gift tax annual exclusion amount every year (that's $14,000 per recipient by an individual or $28,000 by a married couple).

  • Tax Benefits: The first $950 of unearned income is tax-free. The next $950 is taxed at the child's federal tax rate.
  • Pros: The amount in the account isn't just limited to education expenses. The funds in the account can be used for any reason to benefit the minor.
  • Cons: It's not tax-deferred. The investment earnings in the account are taxed. Also, this account is in the child's name and as such, can effect the child's eligibility for financial aid.

Coverdell ESA

These plans let you contribute up to $2,000 per beneficiary annually until that child turns 18.

  • Tax Benefits: The earnings are tax-deferred. Also, qualified withdrawals are tax-free.
  • Pros: The earnings are tax-deferred. Another good thing about Coverdell plans is that they can be used to pay for elementary and secondary education.
  • Cons: You can only contribute a certain amount per year. Also, these plans are limited to those within a certain income bracket. Married couples with a gross income of over $220,000, and single filers with a gross income of $110,000, are excluded from contributing to this plan.

The 529 Plan

These plans allow tax deferred growth of investment earnings.

  • Tax benefits: You don't pay tax on investment earnings until you withdraw the money (they're tax deferred). If the money is withdrawn for education, it's tax-free.
  • Pros: You can gift up to $70,000 per individual or $140,000 per married couple annually without incurring gift tax.
  • Cons: These plans apply to post-secondary education expenses.

President Barack Obama was officially sworn in Sunday for his second term as president of the United States, ahead of Monday's public events.

In a small and succinct ceremony at the White House, Obama recited the constitutionally mandated oath of office for the third of four expected times during his time in office. ?

Embracing his children after the oath, his younger daughter Sasha was heard to whisper ?good job, Daddy!??

"I did it!" he responded, before she observed "You didn't mess up."?

Sunday's official swearing-in, administered by Chief Justice John Roberts, was the 57th inauguration of a president in American history.?

Wearing a dark suit and blue tie, Obama repeated the directive to ?preserve, protect, and defend the Constitution of the United States." He was joined by First Lady Michelle Obama and his daughters Sasha and Malia. ?

After thanking Roberts and waving to cameras, Obama and the first family left the White House's Blue Room. He will deliver his public inaugural address Monday on the west front of the United States Capitol.

During the brief swearing-in Sunday, the first lady -- who wore a dark blue dress -- held the family Bible upon which Obama laid his hand to swear the oath. According to inaugural officials, the Bible was a gift from Mrs. Obama?s father to his mother in 1958.

When Obama first took the oath of office on?Jan. 20?four years ago, he and Chief Justice John Roberts tripped up over the wording, raising concerns about whether the constitutional requirements were fulfilled to the letter of the law.? Roberts went to the White House the next day and administered it again in full.?

The short Sunday?ceremony was held because the constitutionally mandated inauguration date of Jan. 20 falls on a Sunday, so Obama will take the oath a fourth and final time on Monday before hundreds of thousands of observers on the National Mall.?

The Monday ceremonies will include?the president's inaugural address, a?luncheon with the president and members? of Congress and the traditional inaugural parade and?balls.?

Ahead of the ceremony, the Obama family attended church at the Metropolitan African Methodist Episcopal Church in Washington , a historic place of worship that also hosted pre-inaugural services for former President Bill Clinton and Vice President Albert Gore.

Vice President Joe Biden was officially sworn in?at about 8:20 a.m. ET Sunday.

The small?weekend ceremonies for both men are a bit of a historical quirk, although today's swearing-in was the seventh in history to take place on a Sunday.? The last instance occurred in 1985, when President Ronald Reagan was formally sworn in for his second term in office.

Beginning with the second inauguration of Franklin D. Roosevelt in 1937, new presidents and vice presidents have been sworn in on Jan. 20 due to the changes laid out in the 20th Amendment to the Constitution.

(Before that, inaugurations were typically held on March 4, as directed by the 12th Amendment. But controversy over the length of the lame duck period forced that ceremony to be moved up by law).

In addition, eight vice presidents have been administered the oath of office upon the death of a president. The hastily planned ceremonies have taken place in hotels, homes and -- famously, after the death of John F. Kennedy -- aboard Air Force One.?

The oath of office for the president is set out in the Constitution.

Article II, Section 1, states as follows "Before he enter on the execution of his office, he shall take the following oath or affirmation: -- "I do solemnly swear (or affirm) that I will faithfully execute the office of president of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States."

Traditionally, two minor changes are made. First, the president taking the oath says his name after the first word ("I, Barack Hussein Obama"). And second, the phrase "so help me God" is added at the end.?

AP source: Inaugural ball to feature Lady Gaga

WASHINGTON (AP) ? Watch out Beyonce and Katy Perry. There's another diva set to perform during the inauguration festivities ? Lady Gaga.

A person familiar with the inauguration tells The Associated Press that the pop star will perform at Tuesday's ball for President Barack Obama's staffers. The source spoke on condition of anonymity because that person wasn't authorized to publicly reveal the information.

The staff ball is typically a private affair. During the last inauguration festivities, Jay-Z reportedly performed for that event.

According to one attendee, Jay-Z rapped a riff on one of his hit songs, "99 Problems but George Bush Ain't One," to the delight of the throngs of young staffers who worked to elect Obama in 2008.

Mayor Bloomberg Has a Hissy Fit

Apparently it was Mayor Bloomberg who scuttled talks between the city and the unions. The unions wanted a sunset clause, the mayor demanded no sunset clause.

According to Ernest Logan of the supervisors? union, most districts have a sunset clause:

??The CSA and the DOE were closing in on a final agreement on January 16, just before midnight. However, moments later, the Mayor intervened, demanding an agreement for an indefinite period of time,? Logan said.

?It is important to know that the overwhelming majority of school systems throughout the state have reached a one-year agreement in order to evaluate and modify it later to better serve our children. The state law provides for a one-year evaluation plan and the mayor supported the enactment of this legislation,? he added in a statement.?

Greek Politics: The Worst Show on Earth - Greece - Greek Reporter

circusfreaks1As political freak shows go, you just can?t beat Greece, especially when the Three-Ring Circus known as the Parliament is session, if only to see workers paid thousands of euros a month walking around handing out glasses of water and threatening to strike and shut down debate if they?re not exempted from big pay cuts, tax hikes and slashed pensions being imposed on just about everyone except the rich and politicians.

As Thomas Jefferson said: ?Ridicule is the only weapon you can use against unintelligible propositions,? but even that fails when it comes to trying to describe how asinine and pathetic the shootout-in-the-lifeboats is when the 300 Greek lawmakers are in session, which isn?t often, thank Zeus.

What happened when the Parliament decided to pillory an easy target, former finance minister George Papaconstantinou, and vote to investigate only him for his mishandling of a list of 2,062 Greeks with $1.95 billion in secret accounts in the Geneva, Switzerland branch of HSBC Bank is beyond even ridicule, if sadly expected.

It?s a wonder we didn?t see these snakes in seats and suits shed their skins while they were talking and you could almost hear the carnival barker bellowing, ?He walks, he talks, he crawls on his belly like a reptile,? when PASOK Anti-Socialist leader Evangelos Venizelos was thundering like a one-man herd of elephants to protest (methinks too much) his innocence and deny any wrongdoing for not checking for tax cheats when he had the list as a previous finance minister. That was at a time when he was doubling income and property taxes, taxing the poor, and exempting mansions from tax hikes. As talking pachyderms go though, it was a pretty good show.

It was surpassed though by the spectacle of Boy Politician Alexis Tsipras, leader of the major opposition party Coalition of the Radical Left (SYRIZA) and his mock outrage that Venizelos ? who should have been investigated because he had the bank list in his hands ? go before a parliamentary committee and ?splain himself.

Tsipras, apparently still recovering from a failed charisma transplant, tried to convince everyone his interest was justice when it was really just trying to bring down Venizelos. The PASOK leader, who could slide off sandpaper, deserves a fall, but not pushed by a political pygmy like Tsipras ? whose Che Guevara undershirt was almost visible when he was trying to be clever with quips. Watching he and Venizelos go at it proved that it?s hard to joust on high horses.

They should have called this 16-hour debate about nothing The Fall Guy because the fix was in before it even began. With so much fury still being directed against the coalition government led by Prime Minister Antonis Samaras, the head of the New Democracy Uber-Capitalist Banker party, for imposing more pay cuts, tax hikes and slashed pensions, and rage against tax cheats, somebody had to be a patsy and be sacrificed and it was the easy target.

Papaconstantinou fit the bill if only because he?s so disliked for being almost as arrogant as Venizelos, who immediately ejected his buddy from PASOK, but not until Papaconstantinou was smeared in blood and the wolves were baying for meat.

DON?T BOOK ?EM, DAN-O

So eager was Samaras to get this sordid affair behind him, and to protect Venizelos, who in other times would be his enemy, that they made Papaconstantinou the escapegoat. Even a member of CSI Athens: Clueless could figure out that if you?re going to protect your relatives and erase their names from the bank list that you make sure you take out a bunch of others too. And once investigators determined that Papaconstantinou?s relatives had declared their income and paid their taxes, the jig was up for the frame against Papaconstantinou.

There were sideshows aplenty. Former prime minister George Papandreou, who appointed both Papaconstantinou and Venizelos, escaped being investigated too and shamelessly sat in a front row seat a few feet from a ballot box with his name on it until he just kind of vanished like the Invisible Man, one of the biggest attractions under the Big Top of the Greek Parliament.

American white-collar criminals could try using the Venizelos Defense when the FBI comes knocking and just proclaim their innocence and hope the G-Men will say, ?Okay thanks a lot, now we don?t have to investigate even though you had possibly incriminating evidence in your possession and never admitted it until someone else outed you.? That might play in Athens, where politicians protect themselves at all costs, even if it means throwing one of their own kind overboard.

This affair was almost as long as the opening to a Theo Angelopoulos movie, God rest his soul, and as predictable as a bad formulaic movie or one of those French films if can stay awake long enough to watch them. Papaconstantinou was The Dead Man from the get-go, just like in the Jim Jarmusch movie that made you want to shoot the director or flog yourself as punishment for watching it.

Venizelos said the predictable whitewash to protect him was ?a watershed,? and ?not just because SYRIZA?s scheming was exposed ? but mainly because public life has been relieved of the noose that they they have tried to put on it at the expense of the truth, stability and the country?s prospects.? Spoken like a man who has nothing to hide, and since he?s not going to be investigated, who can prove otherwise?

He said Tsipras wanted to bring down the government, which was correct, but that didn?t excuse Greek lawmakers for not having the testicular fortitude to investigate a man who had a critical piece of evidence in his hands and didn?t turn it over until he was exposed for hiding it for more than a year.

If nothing else, Venizelos was derelict in his duty to probe the list for tax cheats. His lame excuse that the names came from stolen data fell apart when Christine Lagarde, the former French finance minister and now head of the International Monetary Fund, one of Greece?s international lenders and the person who gave the original to Papaconstantinou in 2010, said other countries had used a larger list to chase tax cheats. But how would Venizelos know that because he?s only a Constitutional Law professor.

Papaconstantinou has nothing to fear however because the Parliament will some time down the road find there?s no evidence that he removed the names of his relatives and declare it?s a mystery that belongs in Eleufsina.

The story will end like the version of Medea proffered in the movie Never on Sunday, by Melina Mercouri?s character, a prostitute, one of the requirements for being a politician. At the end, she pronounced with all the self-deceit she could muster that Medea didn?t kill her children but they all went to to seashore and nobody got hurt. Now that?s a good show, and more believable.

Former U.S. president and Confederate congressman-elect John Tyler dies

On this day in 1862, former U.S. President and?Confederate congressman-elect John Tyler dies at age 71 in Richmond, Virginia.

Tyler, who?was?born in Virginia in 1790, served as?a U.S. congressman and as governor of his home state before winning election to the U.S. Senate. state?during the 1830s, when many of the sectional issues were emerging in national politics. A Whig, Tyler became the 10th U.S. vice president in March 1841. Within a month of his inauguration, President William Henry Harrison died in office and Tyler vaulted into the executive chair. The major achievement of his administration was the addition of Texas to the Union in 1845.

After his presidency ended in 1845, Tyler?retired to his plantation, Sherwood Forest, in Virginia. His fellow Virginians called on the 70-year-old to head a Peace Convention in the winter of 1860-1861. This body tried to negotiate a compromise with the Republicans in the North to prevent a civil war. The attempt failed, as the Republicans were not willing to entertain any proposals that would protect slavery in the Western territories. ER visits tied to energy drinks double

SAN FRANCISCO - A new government survey suggests the number of people seeking emergency treatment after consuming energy drinks has doubled nationwide during the past four years, the same period in which the supercharged drink industry has surged in popularity in convenience stores, bars and on college campuses.

From 2007 to 2011, the government estimates the number of emergency room visits involving the neon-labeled beverages shot up from about 10,000 to more than 20,000. Most of those cases involved teens or young adults, according to a survey of the nation's hospitals released late last week by the Substance Abuse and Mental Health Services Administration.

The report doesn't specify which symptoms brought people to the emergency room but calls energy drink consumption a "rising public health problem" that can cause insomnia, nervousness, headache, fast heartbeat and seizures that are severe enough to require emergency care.

Several emergency physicians said they had seen a clear uptick in the number of patients suffering from irregular heartbeats, anxiety and heart attacks who said they had recently downed an energy drink.

More than half of the patients considered in the survey who wound up in the emergency room told doctors they had downed only energy drinks. In 2011, about 42 percent of the cases involved energy drinks in combination with alcohol or drugs, such as the stimulants Adderall or Ritalin.

"A lot of people don't realize the strength of these things. I had someone come in recently who had drunk three energy drinks in an hour, which is the equivalent of 15 cups of coffee," said Howard Mell, an emergency physician in the suburbs of Cleveland, who serves as a spokesman for the American College of Emergency Physicians. "Essentially he gave himself a stress test and thankfully he passed. But if he had a weak heart or suffered from coronary disease and didn't know it, this could have precipitated very bad things."

The findings came as concerns over energy drinks have intensified following reports last fall of 18 deaths possibly tied to the drinks -- including a 14-year-old Maryland girl who died after drinking two large cans of Monster Energy drinks. Monster does not believe its products were responsible for the death.

Two senators are calling for the Food and Drug Administration to investigate safety concerns about energy drinks and their ingredients.

The energy drink industry says its drinks are safe and there is no proof linking its products to the adverse reactions.

Late last year, the FDA asked the U.S. Health and Human Services to update the figures its substance abuse research arm compiles about emergency room visits tied to energy drinks.

The Substance Abuse and Mental Health Services Administration's survey was based on responses it receives from about 230 hospitals each year, a representative sample of about 5 percent of emergency departments nationwide. The agency then uses those responses to estimate the number of energy drink-related emergency department visits nationwide.

The more than 20,000 cases estimated for 2011 represent a small portion of the annual 136 million emergency room visits tracked by Centers for Disease Control and Prevention.

The FDA said it was considering the findings and pressing for more details as it undertakes a broad review of the safety of energy drinks and related ingredients this spring.

"We will examine this additional information ... as a part of our ongoing investigation into potential safety issues surrounding the use of energy-drink products," FDA spokeswoman Shelly Burgess said in a statement.

Beverage manufacturers fired back at the survey, saying the statistics were misleading and taken out of context.

"This report does not share information about the overall health of those who may have consumed energy drinks, or what symptoms brought them to the ER in the first place," the American Beverage Association said in a statement. "There is no basis by which to understand the overall caffeine intake of any of these individuals -- from all sources."

Energy drinks remain a small part of the carbonated soft drinks market, representing only 3.3 percent of sales volume, according to the industry tracker Beverage Digest. Even as soda consumption has flagged in recent years, energy drinks sales are growing rapidly.

In 2011, sales volume for energy drinks rose by almost 17 percent, with the top three companies -- Monster, Red Bull and Rockstar -- each logging double-digit gains, Beverage Digest found. The drinks are often marketed at sporting events that are popular among younger people such as surfing and skateboarding.

From 2007 to 2011, the most recent year for which data was available, people from 18 to 25 were the most common age group seeking emergency treatment for energy drink-related reactions, the report found.

"We were really concerned to find that in four years the number of emergency department visits almost doubled, and these drinks are largely marketed

to younger people," said Al Woodward, a senior statistical analyst with the Substance Abuse and Mental Health Services Administration who worked on the report.

Emergency physician Steve Sun said he had seen an increase in such cases at the Catholic hospital where he works on the edge of San Francisco's Golden Gate Park.

"I saw one young man who had mixed energy drinks with alcohol and we had to admit him to the hospital because he was so dehydrated he had renal failure," Sun said. "Because he was young he did well in the hospital, but if another patient had had underlying coronary artery disease, it could have led to a heart attack."

RIM shares jump ahead of BlackBerry 10 launch

TORONTO (Reuters) - Shares of Research In Motion Ltd surged as much as 11 percent on Monday as the countdown toward the January 30 launch of its long-awaited BlackBerry 10 smartphones winds down and carrier support for the new line builds.

RIM stock rose as high C$15.08 in early Nasdaq trading. Some analysts said a dearth of any major smartphone news at the Consumer Electronics Show in Las Vegas last week boded well for RIM as it inches closer toward unveiling the make-or-break new line.

"The lack of new smartphone buzz could be seen as positive given it clears the road for the BlackBerry 10 device announcement January 30," TD Securities analyst Scott Penner said in a note to clients.

The lack of news was expected. Even so, Penner wrote, it reassured investors that the BlackBerry 10 would be competitive with the best that Apple Inc, Samsung Electronics, Nokia and other rivals have on offer.

The stock also got a boost from media reports on Monday that Aircel and Vodafone Group Plc are gearing up to market the new BlackBerry in India. RIM has long counted India for strong growth, especially as its current lineup has lost ground in North America and Europe.

The Indian news comes just days after three of the top U.S. mobile carriers - Verizon Communications, AT&T Inc and T-Mobile USA - signaled that they would support RIM's BlackBerry 10 products.

Shares of RIM were up 9.6 percent at $14.86 at 1100 EST (1600 GMT) on the Nasdaq, while its Toronto-listed shares were up 9.7 percent at C$14.62.

Also Tuesday, about 50 armed Palestinians shut the main road leading into the Balata refugee camp with burning tires to protest repeated attempts by Palestinian security forces to disarm them.

The gunmen have links to Palestinian President Mahmoud Abbas' Fatah movement, and their recent protests have drawn attention to growing discontent with Abbas' rule. Abbas governs the West Bank, while Hamas militants have a rival government in the Gaza Strip.

The Israeli military said Monday that it discovered a tunnel Hamas militants burrowed from the Palestinian coastal territory of Gaza at least 100 meters (yards) deep into Israeli territory. Military spokeswoman Lt. Col. Avital Leibovich said the tunnel was dug in the direction of two Israeli communities, and the assumption was that militants had hoped to use it to stage an attack on civilians.

No Gaza militant group has claimed responsibility for digging the tunnel. Leibovich said it was discovered in the course of a routine military patrol, but would offer no specifics.

The military has discovered other such tunnels in the past. Leibovich said it was not clear whether the tunnel was dug before or after Israel's November offensive against Gaza militants.

Salah Khawaja, one of the activists, said some in the group of about 200 managed to get to the outermost tent and raised a Palestinian flag there before they were taken away.

This isn't Ronnie Brown beating the Patriots on a fluke because they'd never practiced against the Wildcat. Or Michael Vick juking Vikings defenders out of their shoes even though he's being coached by Dan Reeves. Those were one-offs; they weren't repeatable.

But the read option is here to stay. Poor Green Bay trotted out Erik Walden as a QB spy, but they simply had no answer for the read option. The read option looks unstoppable now, but give it time. People said the same thing about the West Coast Offense back in the day. But 100 defensive assistants watching 100 hours of tape each week will come up with an answer. my guess is the QB spy in a read option has to be a safety who can't cover and not a linebacker who can't pass rush. Will Hill totally has a future in this league.

Every offense is a West Coast Offense now. Every playbook has short passes that require timing and accuracy. If you're a quarterback who can't hit those passes then you need to go to the CFL or the Jets. I feel bad for the 6'5 statues who spent their lives thinking they could make a living staying in the pocket, but that's America. Dynamism cuts both ways, Brock Osweiler. When I was in high school I looked at going to Emory because if you're from the North and have good SATs then you're legally obligated to look at Emory. I visited Georgia in the fall and I was shocked to find that more than half of the Atlanta Journal-Constitution sports section was devoted to high school football. That's when I knew I wasn't in Connecticut any more -- this was a place where football was played on Fridays and Saturdays, not Sundays.

But you can't blame Atlantans for indifferent fandom during some pretty lean years. Growing up I had Bill Parcells, not Jerry Fucking Glanville. The only time the Falcons ever made the Super Bowl everyone hated them for it because we wanted to see the Vikings play the Broncos instead. I don't oblige anyone who chooses not to care about a bad football team. If you've got real problems then there's no point in adding a 5-11 season to them.

But now Atlanta finally gets to experience Sunday football with the rest of it. My favorite anecdote was that MARTA conductors were yelling "Rise Up!" after every announcement. Public displays of team affection are the hallmark of a good sports town. It's like when the homeless guy yelled "Who Dat" at me in New Orleans in 2009 or the bartender at Red's Java House talking about the San Francisco Giants in 2010. Atlanta is ready for its close-up.

I did a pretty good job recounting the Patriots' playoff failures earlier. Champ Bailey, Peyton Manning and a couple of Giants wide receivers stand between them and four titles since 2004 instead of zero.

Bill Belichick doesn't have to put himself through this. If he took the University of Texas job he wouldn't even have to win a conference championship game; he could just get through the season with zero to one losses and beat the SEC champ in the title game.

There's one reason why it's easier to build a college dynasty than a professional one. Smaller sample size. Fewer chances for the real champs to screw up. Saban only needs to win two playoff games and one of them is against Mark Richt. Bill Belichick has to win three and two of them come against Harbaugh brothers. There's more time for a fluke ending.

It's easier to build a college dynasty. Not because of recruiting or the relative lack of regulation (seriously, all they have to do is outfox Mark Emmert). No, it's easier to build a college dynasty because you only have one or two playoff games instead of three or four. That's more chance for your process to go astray.

So congrats to Bill Belichick for this win. Sorry you still have two more to go.

Miranda Lambert Uses Photo Ops to Support Animal Rescue

Want a photo with the down-to-earth country star? ?It?ll cost you ? but for a good cause. ?Miranda Lambert is using photo ops with fans as a way to benefit shelter pooches via her MuttNation Foundation.

Multi-talented Lambert, who in addition to singing and recording, runs her own shop, The Pink Pistol, in?Tishomingo, Oklahoma, admits that she is regularly bombarded with requests for photos while she?s working. ?I?m constantly moving merchandise and working the soda fountain, and if I get stopped and asked for a picture, it?d go crazy if I did everybody,? she said.

Lambert devised a novel solution to the age-old celebrity problem of being spread too thin. ??I ask for $100 donation to my Muttnation Foundation? for each photo request in the shop.

So far, her creative approach has raised $2,500 for the Foundation?s work to provide responsible guardianship education, spay-neuter programs, and animal rescue and adoption support.? But she wants her fans to know, this isn?t some celebrity ploy to fund next season?s wardrobe: ?I don?t ever want the perception of people thinking I?m charging money for my photo. ?It?s definitely not for me ? it?s all for the animals.?

The singer, who lives on a ranch with husband Blake Shelton in Oklahoma, has seven dogs, all with southern-themed names, and regularly fosters animals through her Foundation. ?She also encourages her fans to rescue companion animals by posting an adoptable ?Mutt of the Week? from the Tishomingo shelter?via her Twitter.

Transocean stock up as Icahn buys stake

Transocean?stock rose 3 percent Monday on news that billionaire investor Carl Icahn bought a minor stake in the oil drilling company, Transocean.

?Shares of?Transocean?rose 3 percent in morning trading on Monday after it disclosed that billionaire investor Carl Icahn purchased a 1.56 percent stake in the oil drilling company and may want to buy more.

Swiss-based?Transocean?owned the Deepwater Horizon drilling rig which exploded and sank in the Gulf of Mexico in 2010, triggering the nation's worst offshore oil spill. The company recently reached a plea agreement with the Justice Department over its role in the massive oil spill.

Icahn is known for buying stakes in struggling companies and shaking them up.

In disclosing the Icahn stake,?Transocean?also said in a regulatory filing with the Securities and Exchange Commission that Icahn is looking to obtain regulatory approval to potentially buy additional shares worth more than $682.1 million.

If he gets approval, he could become one of?Transocean's?biggest shareholders with about a 5 percent stake. The company's largest stockholder is currently Capital Research & Management, with a 5.12 percent stake, according to FactSet.

Transocean?leased the Deepwater Horizon drilling rig to BP PLC. The rig sank after an explosion killed 11 workers and triggered the spill. The April 2010 blowout of BP's Macondo well spewed more than 200 million gallons of oil into the Gulf.

At a brief hearing last week before a federal magistrate in New Orleans,?Transocean?attorneys didn't enter a plea on the company's behalf to a misdemeanor charge of violating the Clean Water Act.

Transocean?has agreed to pay $400 million in criminal penalties, plead guilty to the charge and pay $1 billion in civil penalties. It isn't expected to enter the plea until next month.

U.S. District Judge Jane Triche Milazzo has scheduled a Feb. 14 hearing to decide whether to accept the criminal settlement. Milazzo only presides over the criminal settlement. A different judge will decide whether to accept?Transocean's?civil settlement with the federal government.

Transocean?can withdraw from its plea deal if Milazzo rejects it.

Transocean?Ltd.'s stock added $1.58, or 2.9 percent, to $55.67 in morning trading Monday. Its shares fell as low as $39.32 in early June and as high as $59.03 in mid-March.

Having your debit card information stolen can be far more damaging than having your credit card information stolen. The convenience of a debit card just isn't worth the risk.?

A few days ago, one of my close friends shared a harrowing story with me regarding identity theft. The person had their checking account compromised and found themselves spending a great deal of time working closely with their bank to resolve all of the issues.

That person was not entirely sure whether everything was cleaned up, but they had fixed many of the worst transaction errors and changed their debit cards and PINs.

My response? ?If I were you, I would never, ever use my debit card outside of an ATM, ever again.?

Here?s the reason: if an identity thief gets ahold of your credit card number, they just have access to your credit card account. While that can cause some minor inconveniences, it doesn?t cause any disastrous life problems.

In this situation, the worst thing that happens is that someone charges your credit card up to the limit, in which case you simply use cash from your checking account to pay for things until you resolve the situation.

On the other hand, if an identity thief gets ahold of your debit card number, they have access to your checking account. This can cause some major problems if you don?t resolve it immediately.

Here, checks can bounce, overdraft costs can occur, bills don?t get paid, and you can be completely without money at moments when you really need it.

For me, the convenience of the debit card just isn?t worth the risk. I want to minimize (or preferably eliminate) the chance that an identity thief can directly access my checking account.

So, how do I pay for things?

I try to use cash wherever possible. I vastly prefer to use cash for face-to-face transactions, for a few reasons. One, there?s no way any identity theft can occur. Two, when I support a local business with cash, they don?t have to pay the usage fees for credit card use. Whenever you use a credit card at a business, that business has to pay a fee because you used the card. Three, it provides a very visual way for my children to understand financial transactions.

I use a single credit card for other situations. I have one credit card that I use for online purchases and for situations where cash is unavailable for purchases. That credit card is tied to the retailer I use most often so I maximize the ?rewards? I get for using that card.

I pay off that credit card in full each month. Whenever that credit card bill comes in, I pay the entire balance on that card. I don?t even allow a dime to sit there from month to month. Any money left on that credit card balance just costs you more money.

I want to avoid identity theft at all costs. The most effective way to do that is to minimize the places where I share sensitive identity information and, if I do share such information, it is information that can be tightly contained and separated from direct access to my money.

Be sensible with your cards and you can go a long way toward minimizing the impact identity theft can have on you.
